This is a Data Protection Policy (“Policy”) issued under the Personal Data Protection Act, applicable to Non-EU subjects only.

In this Policy, “we”, “us”, “our” or “Prima Computer Systems” means PCS, the business unit of Prima Limited, a subsidiary of Prima Group of Companies (collectively referred to as "PCS"), “you”, “your” or “yours” means the persons to whom this Policy applies.

This Policy describes how we may collect, use, disclose, process and manage your Personal Data and applies to any individual’s Personal Data which is in our possession or under our control.

As a customer of PCS, by submitting information to us or signing up for our products and services, you agree and consent for our collection, use, disclosure and sharing within and amongst the Prima Group of Companies, and disclosing such Personal Data to our authorised service providers and relevant third parties, as the case may be, where applicable, as set out herein.

This Policy supplements but does not supersede nor replace any other consents you may have previously provided to PCS in respect of your Personal Data, and your consents herein are additional to any rights which PCS may have at law to collect, use or disclose your Personal Data.

We may update this Policy from time to time to ensure that this Policy is consistent with any developments in the way PCS uses your Personal Data or any changes to the laws and regulations applicable to PCS. We will make available the updated Policy on our website: www.pcspos.com.sg or as notified.

  1. Personal Data

    1. Personal Data means data, whether true or not, about an individual who can be identified (a) from that data or (b) from that data and other information to which PCS has or is likely to have access, including without limitation data in our records as may be updated from time to time.
    2. Personal Data includes (depending on the type of interaction with PCS) your name, date of birth, NRIC number, passport or other identification number, telephone number(s), mailing address, email address, network data and any other information relating to you or any individuals which you have provided to PCS in any forms you may have submitted to us, or via other methods of interaction with you, as the case may be, where applicable.
  2. Collection of Personal Data

    1. We will request your Personal Data:-
      1. When you submit an application or other forms relating to any PCS products and services;
      2. When you interact with our customer service officers, for example via telephone calls, face-to-face meetings, emails and other correspondences;
      3. When you use PCS services, for example via websites and apps or other electronic IT applications including any online accounts with us;
      4. When you request to be included in an email, mailing lists and other forms of updates and communications;
      5. When you respond to our promotions, initiatives or requests for additional Personal Data;
      6. When you are contacted by, and respond to, our marketing representatives and customer service officers;
      7. When we receive referrals from business partners and third parties;
      8. When we seek information from third parties about you in connection with PCS products and services you have applied for; and
      9. When you submit your Personal Data to us for any other reasons.
    2. When you browse our website, you generally do so anonymously (refer to Paragraph 5 Use of Cookies). Our website does not automatically collect Personal Data unless you provide such information or login with your account credentials.
    3. If you provide us with any Personal Data relating to a third party, for example spouse, children, parents, and/or other individuals, by submitting such information to us, you represent to us that you have obtained the consent of the third party to provide us with their Personal Data for the respective purposes.
    4. You should ensure that all Personal Data submitted to us is complete, accurate, true and correct. Failure to do so may result in our inability to provide you with the relevant PCS products and services you have requested.
  3. Purpose of Collection, Use and Disclosure of Personal Data

    1. Personal Data will be collected, used and disclosed by PCS for the following purposes:-
      1. Administering, managing and executing our agreements with you;
      2. Responding to your queries and requests;
      3. Managing the administrative and business operations of PCS and complying with our internal policies and procedures;
      4. Facilitating business asset transactions involving any Prima Group of companies;
      5. Resolving complaints and handling requests and enquiries in relation to PCS business;
      6. Preventing, detecting and investigating crime, analysing and managing commercial risks;
      7. Providing media announcements and responses;
      8. Monitoring, recording phone calls and customer-facing interactions for quality assurance, employee training and performance evaluation and identity verification purposes;
      9. Legal purposes (including but not limited to obtaining legal advice and dispute resolution);
      10. Conducting investigations relating to disputes, billing or fraud;
      11. Delivery of notices, services or products and the marketing of such services or products whether presently or in future, to you;
      12. Maintenance and upkeep of customer records and development, marketing and client profiling activities, organising promotional events;
      13. Credit assessments, financial and background investigation, as the case may be, where applicable;
      14. Meeting any legal or regulatory requirements relating to provision of PCS services and products and to make disclosure to comply with any laws, rules, guidelines and regulations or schemes imposed by any governmental authority where applicable; and
      15. Sending you information by e-mail, regular postal mail, telecommunication means (telephone calls, SMS messages and other electronic format) or internet social media about products and services offered by selected third parties that we think may interest you.
    2. You may at any time withdraw, in full or in part, your disclosure consent given previously, in each case subject to any applicable legal restrictions, contractual conditions and a reasonable time period in Paragraph 6.1 below.
  4. Disclosure of Personal Data

    1. PCS will take reasonable steps to protect your Personal Data against unauthorised disclosure. Subject to the provisions of any applicable law, your Personal Data may be disclosed for the purposes listed in Paragraph 3 above, as the case may be, where applicable, to the following:-
      1. PCS to address your questions and requests in relation to you signing up for any PCS products and services;
      2. Business partners, affiliates, contractors, third party service providers who provide operational or related services or products in connection with our PCS business to facilitate your dealings with us;
      3. Vendors or third party service providers in connection with marketing promotions and services offered by PCS or its preferred partners;
      4. Commercial shops, retailers or our appointed service providers in relation to our loyalty programmes, delivery gift redemption and services or PCS business;
      5. Any business partner, investor, assignee or transferee (actual or prospective) to facilitate business asset transactions involving PCS;
      6. Any government agencies, statutory boards or authorities or industry regulators to comply with any laws, rules, guidelines and regulations or schemes imposed by any governmental authority;
      7. Banks, credit card companies and their respective service providers;
      8. Our professional advisers such as auditors, consultants, lawyers, accountants or other financial or professional advisers in connection with our PCS business; and
      9. Any other party to whom you authorise us to disclose your Personal Data.
  5. Use of Cookies

    1. PCS uses "Cookies", where a small data file is sent to your browser to store and track information about you and your preferences when you visit our website. PCS uses Cookies on its website for the following purposes:-
      1. Enabling certain features and functions on our website, such as remembering your user-id, browsing and other service preferences;
      2. Building up a profile of how you and other users use the website;
      3. Improving the efficiency of our website;
      4. Administering services to you and to advertisers; and
      5. Establishing usage statistics.
    2. PCS does not provide you the option of changing the settings in your web browser or turning off the processing of Cookies.
    3. Advertisements on our website may be provided by third party advertisers and their agencies. These may generate Cookies to track how many people have seen a particular advertisement (or use the services of third parties to do this), and to track how many people have seen it more than once. PCS does not control these third parties and their cookie policies and if you have questions about their cookies policies, please contact PCS and we will try our best to assist by providing you information about these third party advertising agencies.
    4. PCS is not responsible for the Personal Data policies (including Personal Data protection and Cookies), content or security of any third party websites linked to the PCS website.
  6. Withdrawal of Consent, Access and Correction of Your Personal Data

    1. You may at any time enquire or provide feedback relating to your Personal Data, this Policy, withdraw or amend, in full or in part, your consent given previously to any use of your Personal Data in our records subject to any applicable legal restrictions, contractual conditions and a reasonable time period.     2. Please note that if your Personal Data has been provided to us via a third party, you should contact that particular organisation or individual directly to make such queries, complaints, access and correction requests to PCS for you and on your behalf.
    3. If you withdraw your consent to any or all use of your Personal Data, depending on the nature of your request, PCS may not be able to continue providing our products and services to you or administer any contractual relationship, which may in turn result in the termination of any agreements between us. This may result in your being in breach of your contractual obligations or undertakings. In such an event, PCS expressly reserves all its legal rights and remedies.

    • This Policy and your use of our website shall be governed in all respects by the laws of Singapore.

This is a Privacy Notice (“Notice”) issued under the General Data Protection Regulation, applicable to EU subjects only.

In this Notice, “Prima Computer Systems”, “we”, “us” or “our” means PCS and “you” or “your” means you, anyone who deals with us for you and other related people, including (without limitation) your authorised person signatories, directors, partners, employees, members, agents and representatives.

It applies to information we hold about you and individuals connected to your business and explains as follows:

Personal Data” means any data relating to an individual who can be identified from that data, or from that data and other information which we have or are likely to have access to (and includes information which our representatives or service providers have). In addition to factual information, it also includes any expression of opinion about an individual, and any indication of our intentions (or the intentions of any other person) in relation to such an individual.

  1. DATA CONTROLLER

    • We are the controller of your Personal Data. We are responsible for deciding what information we collect and where we collect it. You should be aware that even though PCS is principally responsible for managing your Personal Data, such information may be shared within the PCS for the purposes as described in this Notice. When using your Personal Data, each member of the PCS will comply with the standards as set out in this Notice.
  2. TYPES OF PERSONAL DATA WE COLLECT

    • These are the types of Personal Data that we collect:
      1. Information that you provide to us. The nature of your relationship with us, and the kind of communication that you request from us, will determine the type of Personal Data we may ask for, including but not limited to your email address, first and last names, job title, name of the company you work for, and the country where you are based, your education and employment history.
      2. Information that is passively or automatically collected when you visit our website, including but not limited to how you arrive at our website, the type of browser and operating system you are using, your IP address, and your clickstream and timestamp information (e.g. the pages you have viewed, the time at which such pages were accessed, and the amount of time spent per page).

      3. If you are a customer or potential customer, information obtained by us through our business dealings;

      4. To pursue our legitimate interests, such as (by way of a non-exhaustive list):
        1. To detect and prevent fraud and other potentially illegal activities;
        2. To protect our network and information security (e.g. prevention of personal data breaches and cyber-attacks);
        3. To establish, exercise or defend our legal rights; and
        4. To conduct analytics on our website traffic, e.g. pages and links clicked, patterns of navigation, time spent at a page, devices used, location of users, etc.
    3. Some of the aforesaid reasons for using Personal Data may overlap and there may be other reasons which justify our use of Personal Data.
    4. We will take steps to ensure that Personal Data is accessed only by employees on a need-to-basis as described in this Notice. They are subject to a duty of confidentiality and will only use Personal Data in accordance with our instructions.
  5. HOW WE STORE PERSONAL DATA

    • We have security measures in place to keep your information secure. Where we ask third parties to work on our behalf, we always ensure that they have sufficient information security measures in place.

    • We may send you information about our products and services that we think you may like. If you have agreed to receive marketing and no longer wish to be contacted for marketing purposes, you may always opt out at a later date.

  8. DISCLOSURE OF PERSONAL DATA TO THIRD PARTIES

    1. We may share Personal Data within the PCS for the purposes as described in this Notice.
    2. We may also share Personal Data outside of the PCS for the following purposes:
      1. With third parties whom we have engaged to provide services to us (e.g. administrative, audit, logistics, information technology and research services). These third parties will be bound by appropriate data protection obligations and they will only use and process Personal Data on our behalf in accordance with our instructions and for the purposes as described in this Privacy Notice (and not for their own purposes);
      2. Where we are required under law or regulation to disclose Personal Data; this may include (by way of a non-exhaustive list) disclosure in response to a court order, or release of information to a government authority, regulator or law enforcement agency;
      3. To the extent mandated by law for the protection of our legitimate interests; and
      4. In the event that our business is sold or integrated with another business, Personal Data may be disclosed to the prospective buyer and its advisors (who will be bound by appropriate data protection obligations), and will be passed to the new owner when it acquires the business.
    3. Please be assured that we will not sell, rent or give away your Personal Data to third parties for commercial purposes without your consent.
  9. INTERNATIONAL TRANSFER OF PERSONAL DATA

    1. PCS is a global business. Our customers and operations are located around the world. This means Personal Data is collected on a global basis, and may be transferred to locations outside of the country where it is collected.
    2. We will always ensure that any international transfer of Personal Data is consistent with legal and regulatory requirements, e.g. (by way of a non-exhaustive list):
      1. Where Personal Data is transferred to a country outside of the European Economic Area (“EEA”), such country is recognised by the European Commission as providing an adequate level of protection for Personal Data;
      2. Where Personal Data needs to be transferred to a recipient based in a country outside of the EEA which is not recognised by the European Commission as providing an adequate level of protection for Personal Data, we will require such recipient to be bound by standard contractual clauses which are approved by the European Commission for the protection of Personal Data;
      3. Where Personal Data is transferred from within the European Union to the United States, the recipient is a certified participant in the EU-U.S. Privacy Shield Framework; and
      4. Where Personal Data is shared internationally within the PCS, such transfer is subject to Binding Corporate Rules which adequately safeguards the protection of privacy.
  10. HOW LONG WE KEEP PERSONAL DATA

    1. We will retain Personal Data for only as long as is reasonably necessary for the purposes described in this Notice.
    2. In some circumstances, however, legal or regulatory requirements may obligate us to retain Personal Data for a longer period of time.
  11. YOUR RIGHTS

    1. You have the following rights in relation to your Personal Data:
      1. Require us to provide information regarding your Personal Data, e.g. give you a copy of the Personal Data about you that we hold, let you know where we got your Personal Data, how we use your Personal Data, what we use it for, who we disclose it to, whether we transfer it to another country (and where), how we protect it and how long we keep it for (if such information is not already provided in this Notice);
      2. Require us to rectify your Personal Data if it is inaccurate or incomplete; we may seek to verify any new information provided by you before we rectify our existing records;
      3. Where the use of your Personal Data is based on your consent (see Paragraph 4.1.1), you can withdraw your consent at any time; however, please note that we may still be entitled to use your Personal Data if we have another legitimate reason to do so, e.g. for a purpose as described in Paragraph 4.2;
      4. Where the use of your Personal Data is based on our legitimate interests (see Paragraph 4.2.4), you can object to such use if you believe your fundamental rights and freedoms outweigh our legitimate interests; however, there may be circumstances where we have a legal basis to deny your request;
      5. Require us to delete your Personal Data, but only where:
        1. You have withdrawn your consent for us to use your Personal Data (where the use of your Personal Data is based on your consent) (see Paragraph 4.1.1);
        2. It is no longer needed for the purpose for which it was collected;
        3. You have successfully objected to the use of your Personal Data (see Paragraph 8.1); or
        4. We are required by law or regulation to do so.
        • However, we are not obliged to comply with your request to delete your Personal Data if we are legally entitled to retain it, e.g.: for a purpose as described in Paragraph 4.2;
      6. Require us to retain but not use your Personal Data; note, however, that this right is only available to you where:
        1. You dispute its accuracy, and we are verifying it (see Paragraph 8.2.2);
        2. Its use is unlawful, but you do not want us to delete it;
        3. It is no longer needed for the purpose for which it was collected, but we still need it to establish, exercise or defend our legal rights; or
        4. You have raised your objection to the use of your Personal Data, and we are verifying whether we have a legal basis to deny your request (see Paragraph 8.2.4).
        • Nonetheless, we are legally entitled to continue to use your Personal Data following a request by you not to use it, where:
          1. We have your consent;
          2. We need to do so in order to establish, exercise or defend our legal rights; or
          3. We need to do so in order to protect the rights of another natural or legal person;
      7. Where you have given us your Personal Data, require us to provide such data to you in a structured, commonly used and machine-readable format, or transmit such data to a third party where this is technically feasible; note, however, that this right is only available to you where:
        1. The legal basis for processing your Personal Data is either your consent or the performance of a contract with you; and
        2. Such processing is carried out by us using automated means (i.e. excluding paper files);
      8. Where your Personal Data is transferred outside of the EEA, require us to provide information on the safeguards under which such information is shared; and
        • To lodge a complaint with your national Personal Data Protection Commission about how we use your Personal Data; we ask that you please speak with us first to resolve any issues, but you have the right to contact your national Personal Data Protection Commission at any time if you wish to do so.
    2. To exercise your rights, you may contact us at any time by contacting us as provided in Paragraph 12. We may need to ask you for proof of identity when you contact us, so that we can be sure that your Personal Data is not disclosed to any person who has no right to receive it.
